Goldman wins State House, next municipal election will be in November
Cape Elizabeth voters have sent Connie Goldman, former superintendent of schools here, to Augusta.
Goldman, a Democrat, won election to the State House of Representatives Tuesday, defeating Republican opponent Michael Mowles for the right to represent most of Cape Elizabeth in Dist. 121. The vote was 3,043 for Goldman, 2,407 for Mowles. Mowles, a Town Councilor, had said that he would continue to serve on the council even if elected to the State House.
Cape Elizabeth voters will also have their next municipal election for Town Council and School Board members next November, rather than May. A charter amendment to move municipal elections to November won handily, 4,708 to 1,116.
On the national ballot, Cape voters favored Democrat John Kerry over incumbent President George W. Bush, 3,679 to 2,548.
A state referendum to place a 1-percent cap on property taxes found great disfavor with Cape voters, with 4,444 voting against the proposal, and 1,862 voting for it.
In a related vote, Cape voters approved a municipal referendum ratifying existing municipal debt, to be taxed outside of the cap if the tax-cap passes. That vote was 3,995 to 1,812.
Voter turnout was estimated at 81 percent, with 6,404 voting out of an approximate 7,900 registered voters, said Town Clerk Deborah Cabana. Approximately 3,400-3,500 took advantage of Maine's "no-reason" absentee balloting allowance, she said, with election officials working all day to tally votes that were cast absentee.

ARTICLE VII
Nominations and Elections
Sec. 1. Municipal elections. ICommencing in the year 19872005, the regular election for the members of the town council and the school board shall be held on the first Tuesday after the first Monday in DecemberNovember. In each subsequent year the regular election for the members of the town council and the school board shall be held on the first Tuesday in May. All elections shall be conducted on a non-partisan basis and without party designations on the election ballot. The terms of those town councilors and school board members in office on January 1, 19882005, shall expire on the second Monday of JuneDecember next following completion of their three years in office provided their successor has been elected and qualified. following the second anniversary of the commencement of such terms, except those terms expiring in 1988 shall expire on July 1.

Commencing in year 2005, Tthe town council shall meet at the usual place for holding meetings on the second Monday in JuneDecember following the regular municipal election, except in 1987 they shall meet on the second Monday in December, and in 1988 they shall meet on July 1, and at said meeting the councilors-elect shall be sworn to the faithful discharge of their duties by the Town Clerk or by a notary public.

Sec. 3. Organization and Quorum. TCommencing in year 2005, the members of the school board shall meet for organization on the second Monday in JuneDecember following the regular municipal election, except in 1987 they shall meet for organization on the second Tuesday in December, and in 1988 shall meet for organization on July 1. A and at said meeting the members-elect shall be sworn to the faithful discharge of their duties by the Town Clerk or by a notary public, and a record made thereof. The majority of the whole number of the school board shall be a quorum.

Sec. 2. Nomination. Registered voters of the town shall be nominated for the council or school board only by the use of nomination papers in accordance with the statutes of the State of Maine, provided nevertheless, that notwithstanding anything contained in said statutes to the contrary, including without limitation, 30-A M.R.S.A. §2528(4)(C) and (D), completed nomination papers must be filed with the town clerk during business hours by the 60th day prior to election day. They must be accompanied by the written consent of the person proposed as a candidate agreeing:
(1) to accept the nomination if nominated;
(2) not to withdraw; and
(3) if elected at the municipal election, to qualify as such municipal officer or school board member.
A nomination paper that complies with the above requirement is valid unless a written objection to it is made to the town council by the 2nd day following the deadline for submission of a nomination paper. All other provisions of 30-A M.R.S.A. §2528 not inconsistent with the foregoing remain applicable, including 30-A M.R.S.A. §2528(4)(E).

Shall the Following Question Be Approved: "Shall the Town of Cape Elizabeth's currently outstanding and authorized debt which has not previously been approved by the voters in a general election, including direct debt of $25,189,962, and all contingent debt and overlapping debt, be ratified and approved?"
Treasurer's Certificate
The undersigned Treasurer of the Town of Cape Elizabeth hereby certifies:
1. The intent of this question is to ask whether the Town's already authorized and outstanding debt will be ratified and approved by the voters as an exemption to the proposed statewide tax cap. It does not authorize any new debt. Any debt already exempt from the statewide tax cap if enacted will remain exempt regardless of the outcome of the vote on this question.
2. The total amount of general obligation debt of the Town of Cape Elizabeth outstanding on June 30, 2004 was $17,499,962.
3. The total amount of general obligation debt (including any notes in anticipation thereof) of the Town of Cape Elizabeth authorized, but unissued, was $9,450,000 on June 30, 2004 of which $3,725,000 was issued in August 2004 and $1,000,000 interest free is being issued in the Fall of 2004, as part of $9,450,000 approved by the voters in a non-general election on November 4, 2003.
4. The interest cost associated with the Town's outstanding debt as of June 30, 2004 was $5,642,099 to maturity which would result in a total cost of principal and interest to be paid at maturity of $23,142,061. During the period July 1, 2004 to June 30, 2005, $1,550,619 in principal is being retired and $703,348 in interest is being paid. School debt of $4,725,000 being issued in FY 2005 will incur an interest expense of $1,438,570 to maturity. The remaining school debt authorization of $4,725,000 approved by the voters on November 3, 2003 is anticipated to be issued in 2005.
5. The contingent and overlapping debt of the Town of Cape Elizabeth includes a $670,875 share of the debt of Cumberland County, $1,063,000 of the Portland Water District Wastewater Fund debt, $1,775,384 of the Portland Water District Water Fund debt, $2,630,980 of the Regional Waste Systems, Inc. Incinerator debt and $246,233 of the Regional Waste Systems, Inc. Material Recycling Facility debt.
The foregoing represents an estimate of costs associated with the Town's already issued and outstanding debt and all authorized debt. Such estimates may change due to market conditions. The validity of the voters' ratification of this debt shall not be affected by any errors in the foregoing figures. The ratification by the voters is conclusive and the validity of the ratification of the Town's debt is not affected by reason of any variance of actual costs from the figures provided above.
