23:44 Item# 13-2010 Acceptance of 2009 Gifts and Donations
Each year the Town of Cape Elizabeth receives a number of gifts of money and donation of services. They are formally accepted each December with appreciation to the generous donors.
25:19 Item# 14-2010 Post Construction Storm water Management Ordinance
A draft ordinance is attached that would bring the Town of Cape Elizabeth into compliance with the Maine Department of Environmental Protections MS4 general permit and into compliance with the Federal Clean Water Act. It is recommended that it be referred to the Ordinance Committee.
26:22 Item# 15-2010 Update on 2008 Bond
The following is an update on the 2008 bond. 80% of the $2,550,000 in proceeds has been expended. An additional 9% has been allocated and will soon be expended. The amount remaining that was once allocated, but is no longer allocated or projected to be expended is $262,965.
The town manager recommends that $52,000 of the unallocated amount be provided to add to an anticipated $85,000 in stimulus funds for lighting updates at the High School, Middle School, Elementary School and Community Center.
The estimated payback period in terms of electricity charges is an estimated 2.4 years. The payback return on the local part of the investment is just over 12 months. The 15 year savings is estimated at over $846,000. The Alternative Energy Committee recommended these lighting projects as the best option in applying for the currently available stimulus funds. The maximum grant is $85,000. The local match requirement is 10% but with the short payback period it is advised to complete the lighting changes in all four buildings. It is proposed the bond amortization for the $52,000 remain in the municipal budget.

The town manager recommends approval of a grant application in the amount of $85,000 to the Maine Public Public Works Commission for an American Recovery and Reinvestment Act Grant for lighting updates within the school buildings and the community center.
The projected annual energy savings in Kilowatt Hrs is anticipated to be 280,881 with 15 year life time KWH savings of 4,213,215. A total of 95,836,597 annual BTUs saved and a projected lifetime energy savings of 14,375,486 BTU. Both estimates are based on 3000 hours of operation per year.
The equivalent Environmental Impact Reduction for greenhouse gas emission is 201 metric tons per year and 3,015 tons per 15 year life cycle. The reduction of CO2 is 434,661 (lbs) per year or 6,519.915 (lbs) per 15 year life cycle.
The Town of Cape Elizabeth anticipates an annual cost of energy savings of $56,420. The energy savings per 15 year cycle is estimated to be $846,300.
34:02 Item# 17-2010 Update on Refinancing of 1998 and 1999 Bonds
On October 15, 2009, the Town refinanced bonds issued in 1998 and 1999. It is proposed to credit to the School Department the premium on the school portion of the bonds amounting to $73,110.35. This amount was calculated by our financial adviser.
This results in a school budget savings for this year of $105,685.18 including the premium and the interest savings. The municipal budget had interest savings and a premium of $160,687.64 but is assuming the $41,834.62 costs of issuance leaving a net municipal budget savings of $118,853.02.
Over the life of the replacement bonds, the total school budget savings is $232,036.61 and the municipal savings is $509,711.67 resulting in a total savings of $741,748.28.
The recommended Town Council action is to credit the School Department the $73,110.35 premium.
All other savings will occur automatically.

42:27 Item# 18-2010 Report from Fort Williams Advisory Commission
The Fort Williams Advisory Commission has submitted a report with recommendations on how Fort Williams Park might become self sustaining. It is recommended to acknowledge receipt of the report and to consider its recommendations in early 2010.
