The Town is soliciting bids for the Shore Road Path.
The project, a 2.2-mile pathway along Shore Road, is being funded by a federal grant, private donations and municipal sources.
Sealed bids will be opened at 2 p.m. Thursday, May 24, in the town manager's office at Town Hall.

Phone: (207) 761-1770The work of the project involves construction of an HMA multi-use path along Shore Road from the main entrance of Fort Williams to the intersection of Shore Road and Route 77 (approximately 2.1 miles). The project also includes hot mix asphalt curb, miscellaneous grading, drainage pipe and associated structures, timber rail, pre-manufactured pedestrian bridge, chain-link fence, modular block walls, pedestrian crosswalk flashing beacons, miscellaneous landscaping, and surface restoration.
This project is being funded in part by FHWA funds, reimbursable through the Maine Department of Transportation Local Project Administration Program. This contract is subject to all applicable Federal and State laws, policies, and procedures. This contract is subject to compliance with the Disadvantaged Business Enterprise program requirements, as set forth by the Maine Department of Transportation. Award will be made to the lowest responsive, responsible bidder.
Bids will be accepted from all bidders. The lowest responsive bidder must have completed, or successfully complete, a highway, paving, or project specific prequalification to be considered for the award of this contract.
Work shall be primarily governed by “State of Maine, Department of Transportation, Standard Specifications, Revision of December 2002,” Repair Spec, and “State of Maine, Department of Transportation Standard Details, Revision of December 2002.” Standard Specifications, Standard Specifications Updates, Standard Details, and Standard Details Updates can be found at: http://www.maine.gov/mdot/contractor-consultant-information/ss_standard_specification_2002.php or obtained from the Maine Department of Transportation, Bureau of Project Development, Contracts & Specifications Unit, 16 State House Station, Augusta, ME 04333-0016.
The Town of Cape Elizabeth, P.O. Box 6260, 320 Ocean House Road, Cape Elizabeth, Maine 04107 will receive sealed bids until 2:00 p.m. prevailing time, on May 24,2012 at the office of the Town Manager, 320 Ocean House Road, Cape Elizabeth, Maine. Bids after this time will not be accepted. Bids will be opened and publicly read aloud after specified closing time. All interested parties are invited to attend.

Contractors can obtain a set of contract documents for a fee of $50.00 plus $20.00 shipping and handling. Make all checks payable to AMEC Environment & Infrastructure, Inc. This charge is non-refundable. Documents will be available on May 3, 2012 from AMEC Environment & Infrastructure, Inc.
The construction shall be completed within the time limit of 120 calendar days. Liquidated damages in the amount stipulated in the conditions of the contract will be assessed for every day beyond the contract duration that the work remains incomplete.
A 5% Bid Bond is required to be submitted with the bid. The successful bidder will be required to furnish a 100% Performance Bond and 100% Payment Bond to cover the execution of the contract which shall be in conformity with the forms of bonds indicated in the Specifications and for the contract amount. The Town of Cape Elizabeth reserves the right to waive all informalities and reject any and all proposals or to accept any proposal.
Minority and Woman Business Enterprises Requirements
Each bidder shall take special notice of the Guidance for use of Minority and Woman Business Enterprises in sub-agreements. Failure to complete the requirements of this program may result in finding that the bidder is non-responsive and therefore, not entitled to award of this contract. Bidders on this work will be required to comply with the President’s Executive Order No. 11246 and amendments or supplements to that Order. The requirements for bidders and contractors under this Order are explained in the Instructions for Bidders.Federal Requirements
The Contractor must comply with the Department of Labor Regulations relating to Copeland “Anti-Kickback Act” (18 U.S.C. 874) as supplemented by 29 CFR Part 3, Contract Work Hours and Safety Standards Act (40 U.S.C. 327-330) as supplemented by 29 CFR Part 5, and Occupational Safety and Health Standards (OSHA) (29 CFR Part 1910).The Contractor must comply with all applicable standards, orders, or requirements issued under Section 306 of the Clean Air Act (42 U.S.C. 1857(h)), Section 508 of the Clean Water Act (33 U.S.C. 1368), and Executive Order 11738.
